Melissa & Doug Messaging Terms & Conditions

PLEASE READ THESE TERMS CAREFULLY AND MAKE SURE YOU UNDERSTAND THEM BEFORE USING THE MESSAGING SERVICE. These Messaging Terms and Conditions (“Terms”) govern messages sent by Melissa & Doug, LLC and its representatives, employees, agents, and service providers (collectively, “Melissa & Doug”, “we”, or “our”). Your use of the Service (as defined below) constitutes your agreement to these Terms, Melissa & Doug Terms of Use, and the Melissa & Doug Arbitration Agreement. You also acknowledge and understand we may process your personal information in accordance with our Privacy Notice. We may modify or cancel the Service or any of its features without notice. To the extent permitted by applicable law, these Terms may be updated by Melissa & Doug at any time without prior notice. By continuing to be enrolled in the Services following the effective date of any such update, you agree to any changes.

PLEASE NOTE THAT THE ARBITRATION AGREEMENT CONTAINS A WAIVER OF YOUR RIGHT TO PARTICIPATE IN A CLASS ACTION OR REPRESENTATIVE LAWSUIT. FOR MORE INFORMATION, PLEASE SEE BELOW.

By opting in to the Service you agree to receive recurring automated promotional and personalized marketing text (e.g., SMS and MMS) messages (e.g. cart reminders) or service-related messages (e.g., transactional, operational, or informational text messages including order updates or account alerts) from Melissa & Doug (“Service”), including text messages that may be sent using an automatic telephone dialing system, to the mobile telephone number you provided when signing up or any other number that you designate, even if your mobile number is registered on any state or federal Do Not Call list.

Consent to receive automated marketing text messages is not a condition of any purchase.

We do not charge for the Service, but you are responsible for all charges and fees associated with text messaging imposed by your wireless provider. Message and data rates may apply for any messages sent to you from Melissa & Doug, and messages you send to us. Check your mobile plan and contact your wireless provider for details. You are solely responsible for all charges related to SMS or text messages, including charges from your wireless provider.

By opting into these Services or by otherwise providing your cell phone number to Melissa & Doug, you warrant that you are 18 years of age or older or the age of majority in your state of residency. You further warrant that you are the current subscriber or authorized user of the phone number you have provided, and that you are authorized to consent to the receipt of text messages at that number, and that you are authorized to approve any related charges for messaging and data applied by your wireless carrier. You agree that you will not initiate messages to the mobile phone of any other person or entity without authorization. Failure to do so constitutes a material breach of these Terms and Melissa & Doug’s Terms of Use.

Message frequency will vary. Melissa & Doug reserves the right to alter the frequency of messages sent at any time, so as to increase or decrease the total number of sent messages. We may suspend or terminate your access to these Services for any reason and at any time. Melissa & Doug also reserves the right to change the short code or phone number from which messages are sent and we will notify you when we do so.

Melissa & Doug provides the Service on an “as is” and “as available” basis. MELISSA & DOUG DOES NOT MAKE ANY WARRANTIES AS TO THE SECURITY OF YOUR COMMUNICATIONS. YOU HAVE THE SOLE RESPONSIBILITY TO SECURE YOUR COMMUNICATIONS.

You acknowledge and understand that not all mobile devices or handsets may be supported and our messages may not be deliverable in all areas. Melissa & Doug, its service providers and the mobile carriers supported by the program are not liable for delayed or undelivered messages, any errors in information sent through the Service, any action you may or may not take in reliance on the information or Service, and/or changes to the participating carriers. To the fullest extent permissible under applicable law, we are not responsible and will not be liable for any damages of any nature, including without limitation any incidental, special, consequential, or punitive damages, or attorneys’ fees.

Cancellation

You may opt-out of the Service at any time. Text the keyword STOP, END, CANCEL, UNSUBSCRIBE or QUIT to our shortcode to cancel. After texting STOP, END, CANCEL, UNSUBSCRIBE or QUIT to our shortcode you may receive one additional message confirming that your request has been processed. No further messages will be sent to your mobile device, unless initiated by you. If you unsubscribe from one of our text message programs, you may continue to receive text messages from Melissa & Doug through any other programs you have joined until you separately unsubscribe from those programs, except where applicable law requires otherwise.
